Clearing the Air: Addressing Medical Marijuana in the Workplace

Medical marijuana is growing in New York State and the number of certified patients has more than tripled since June 2016. The state has added new conditions to the list of those that qualify for certification and appears to be embracing this program. Now more than ever it is important for employers to have policies and procedures in place to address accommodation of the certified user employee and remain in compliance with the law. In this program, Elizabeth Grogan will provide a brief overview of the New York Compassionate Care Act and how it applies to employers as well as an update on where we stand nearly three years after the bill was signed into law. She will provide guidance for workplace policies and procedures and insight into what the courts are focusing on in the employment context to help you keep your workplace safe within the bounds of the law.

Elizabeth Grogan is a partner with Wilson, Elser, Moskowitz Edelman & Dicker, LLP. She practices in the area of general civil defense, primarily in cases involving toxic tort and medical/dental malpractice, with significant experience in employment and labor law, professional malpractice and product liability. She has also defended motor vehicle and slip-and-fall cases.
