James J. Barriere and Michael L. Koenig, partners in Hinckley Allen’s Albany, NY office, were named 2015 Upstate New York Super Lawyers. Jim was named Super Lawyer in Construction Litigation while Mike was named Super Lawyer in Commercial Litigation and Criminal Defense: White Collar.
As vice chair of the Construction Law Group, Jim’s primary focus has been on the representation of general contractors, specialty subcontractors, public and private owners and sureties in a variety of claims and matters. He has successfully appeared in numerous arbitration proceedings, jury and non-jury trails and appellate courts in multiple state and federal jurisdictions.
Jim is an experienced trial and appellate lawyer. His experience includes: (i) serving as lead trial counsel in defense of hundreds of millions in claims on a substantial industrial nuclear storage facility; (ii) serving as lead trial counsel for several municipalities involving a collapsed and deficient sewage treatment facility; (iii) drafting and negotiating EPC and general construction contracts for a multi-billion dollar microchip manufacturing facility; (iv) negotiating construction contracts throughout the United States and in Mexico and Saudi Arabia; (v) serving as a panel construction arbitrator for the American Arbitration Association; (vi) successfully appealing and arguing two cases with state-wide implications to the highest court in New York State; and (vii) numerous successful bench trials, jury trials and arbitrations.
Mike is a former federal prosecutor at the Department of Justice in Washington, D.C. and is currently a partner in the Government Investigations & White Collar Defense practice at Hinckley Allen. He has handled many high-stakes and high profile matters, including public corruption cases, both as a defense attorney and prosecutor. Mike defends and advises clients in all aspects of white collar criminal matters, government investigations, corporate internal investigations, and complex civil litigation on the state and federal level. In private practice, he has represented business leaders, public officials, licensed professionals, companies, and institutions across many industries in a wide and diverse range of matters.
While a federal prosecutor at the Department of Justice, Mike prosecuted a variety of white collar crimes, but specialized in corporate fraud investigations and prosecutions. In 2004, he received the Assistant Attorney General’s Award for Financial Integrity for his work in the corporate fraud arena. As a result of his combined defense and prosecutorial background, Mike brings a substantive, procedural, and practical perspective and analysis to all cases in order to ensure a successful result, whether through trial or a favorable pre-trial resolution.
