Frank R. Gerber & James R. O’Connor Join Tully Rinckey PLLC’s Firm As Associates

Tully Rinckey PLLC is pleased to announce that Frank R. Gerber and James R. O’Connor have joined the firm’s Buffalo, N.Y. office as Associates. Both Gerber and O’Connor are great additions to the firm’s federal employment and employment law practice areas.

As an Associate at Tully Rinckey PLLC, Gerber focuses his practice on federal employment law. Gerber exclusively handles Butterbaugh and O’Farrell claims for federal employees. In both cases the Federal Circuit ruled in favor of military personnel who were improperly charged military leave. In O’Farrell v. Department of Defense, the United States Court of Appeals, Federal Circuit, ruled in February, 2018 that Michael O’Farrell, Jr. was entitled to 22 additional days of paid military leave from the Department of Defense for serving at the U.S. Navy’s Naval Surface War Center (NSWC) in 2013.

Prior to joining Tully Rinckey PLLC, Gerber was an Associate Attorney at Krompier & Tamo, L.L.C. in Parsippany, N.J., where he worked on numerous aspects of medical malpractice litigations including, but not limited to, document review, retention of expert witnesses, motion practice, oral argument, and trial preparations. Gerber received his law degree from Ave Maria School of Law in Naples, Florida.

As an Associate at Tully Rinckey PLLC, O’Connor focuses his practice on labor and employment law. O’Connor represents clients in federal and private sector employment law claims, including claims involving the Uniformed Services Employment and Reemployment Rights Act (USERRA), Title VII of the Civil Rights Act, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), Family and Medical Leave Act (FMLA), Fair Labor Standards Act (FLSA), National Labor Relations Act (NLRA), New York Labor Law, New York Executive Law and Qui Tam claims.

Prior to joining Tully Rinckey PLLC, O’Connor was a Court Assistant for the New York State Unified Court System in Olean, N.Y., where he clerked for Support Magistrate Schavon Morgan, managed the support calendar to comply with standards and goals and processed petitions for custody and support. He also drafted orders of support, orders of protection, and temporary custody orders. O’Connor obtained degrees from University of Detroit Mercy and Hofstra University Maurice A. Deane School of Law.
